CONTRACT & RECEIPT
DESCRIPTION OF SERVICE
EZRentList is a prepaid rental listing service. We are licensed by the California Department of Real Estate. EZRentlist agrees to accept as payment in full the below stated amount and upon provision of payment agrees to furnish the prospective tenant for the term of this contract rental information consisting of referring the prospective tenants to landlords or property agents who have reported available rentals to us. EZRentList makes an honest and diligent effort to acquire accurate information furnished by the landlords or property agents. The greater portion of EZRentList's information is obtained by use of the telephone; therefore, our representation and description of rentals will reflect the information given to us by the landlord or property agent. The listings are updated daily, but the availability and the price of the rental may change without notice, due to the nature of the real estate market. The fee is a one-time fee of $60 for 90 days. The prospective tenant may come into our office to pick up listings daily [please see below for office hours], or go straight to our website and search/print the desired listings themselves. The search of the website itself is conducted in a way to better accommodate the prospective tenant's search for rentals. They choose specific criteria from a list of options that EZRentList has to offer in order to narrow the search to what fulfills their specified categories. The completion of this contract also serves as the receipt of the $60 paid by the prospective tenant to EZRentList for its services (you may print this for your records). The purchase of any goods or services other than the provisions of listings of residential real properties for tenancy is optional.
RIGHT TO REFUND
"If, within five days after payment of a fee, the licensee has not supplied the prospective tenant with at least three available rental properties meeting the specifications of the contract as to (i) type of structure; (ii) designated area; (iii) furnished or unfurnished; (iv) number of bedrooms; (v) maximum rental; and (vi) any other specification expressly set forth in the contract, the full amount of the fee paid shall be refunded to the prospective tenant upon presentation of evidence of that failure within 10 days after the expiration of the five-day period. The prospective tenant is not entitled to a refund if the prospective tenant obtains a rental through the services of the licensee.
If the prospective tenant obtains a rental other than through the services of the licensee during the term of this contract or if the prospective tenant does not obtain a rental through the services of the licensee during the term of the contract, the licensee shall refund the fee received in excess of a $50 service charge to the prospective tenant within 10 days after the prospective tenant supplies either (i) reasonable documentation of the prospective tenant's new rental or of the fact that the prospective tenant did not move, such as a lease, rental agreement or utility bill, with sufficient information to verify that the new rental was not obtained through the services of the licensee or that the prospective tenant did not move, or (ii) if the prospective tenant is unable to locate or provide that documentation, the prospective tenant may, at his or her option, fill out a written form provided by the licensee and signed by the prospective tenant under penalty of perjury stating that he or she did not obtain a rental through the services of the licensee during the time of contract.
To be entitled to a refund in excess of the service charge, the prospective tenant must mail or deliver the demand for refund not later than 10 days after the expiration of the contract, and must supply either (i) reasonable documentation of the prospective tenant's new rental or of the fact that the prospective tenant did not move, such as a lease, rental agreement or utility bill, with sufficient information to verify that the new rental was not obtained through the services of the licensee or that the prospective tenant did not move, or (ii) a written form provided by the licensee and signed by the prospective tenant under penalty of perjury stating that he or she did not obtain a rental through the services of the licensee during the time of the contract. The documentation may be supplied after the demand for a refund is mailed or delivered, provided that it is supplied within a reasonable time after it becomes available."
REFUND EXEMPTION
The listing information on EZRentList is considered proprietary and confidential. Thus the use of EZRentList and its information is only granted only for the sole purpose of seeking and locating a rental unit for personal use. This policy also excludes disclosing information to third parties, as any information obtained from EZRentList's database should remain confidential. If rental information is purchased for non-personal use, or if used by someone other than the designated person on the account, refund requirements will not be applicable, and the member shall not be entitled to the return of any part of the fee paid to EZRentList. In addition, further legal action may be taken against the offender of our policy.
SMALL CLAIMS REMEDY
You may bring a small claim court action against the licensee for his/her refusal to make a refund on your demand of all or part of the fee paid by you under this contract. If the court finds that the licensee has acted in bad faith in refusing to make the refund, the court has the authority to award you up to one thousand dollars ($1,000) in addition to damages actually sustained to you.
This contract is for your exclusive use only and my not be used by more than one person. Failure to comply will result in immediate termination. Unauthorized distribution of this contract, or any portion of it, may result in legal action. Eclassified Conglomerate, Inc./EZRentList.com does not guarantee the accuracy of information provided by owners, managers, agents, or representatives of any residential unit listed. Eclassified Conglomerate, Inc./EZRentList.com does not promise or guarantee that an agreement will be reach with any owner of any property listed.
